Terms & Conditions

Effective Date: May 1, 2025

By engaging Tosca Web Design for any service, you (“the Client”) agree to the following terms and conditions:

1. Business Structure & Jurisdiction

Tosca Web Design is a sole proprietorship based in New York, United States. The laws of the State of New York govern all services, communications, and agreements.

2. Payments & Billing

Web Design Projects:

  • Projects over $500 require a 50% deposit upon booking, with the remaining balance due upon project completion.

  • Projects under $500 must be paid in full at the time of booking.

  • Launch in a Day requires a deposit to reserve your day, and final payment is due before 9:00 AM on the launch day.

  • Payments may be made via credit card, PayPal, Amazon Pay, Google Pay, Klarna, or AfterPay (subscriptions excluded).

  • Refunds:

    • Launch in a Day: If canceled after deposit, your payment will be refunded minus a $100 service fee.

    • Standard Web Design Packages: If canceled within the first two weeks and after two rounds of revisions, your deposit will be refunded minus a $300 cancellation fee.

Subscriptions:

  • Subscription-based services (domain registration, web hosting, website maintenance, etc.) are billed annually at the time of purchase.

  • Subscriptions renew automatically each year until canceled by the client.

3. Timelines & Client Responsibilities

  • All standard web design projects (excluding Launch in a Day) must be completed within 60 days from the project start date.
    If the project remains unfinished due to delayed client feedback or final approval, a Design Extension Fee of $25/week will be applied until completion.

  • Clients are expected to provide all required content (text, images, etc.) within the 60-day project window.

  • Unlimited revisions are included within the active design window.
    Edits requested after final approval will be billed according to the current à la carte pricing menu.

4. Ownership & Usage Rights

  • Upon final payment, the client owns all deliverables: website files, graphics, layouts, and content.

  • Tosca Web Design retains the right to display the finished website and design assets in portfolios, marketing materials, and social media.

  • Client testimonials may be used for promotional purposes.

5. Hosting & Domains

  • Clients who purchase domain and hosting through Tosca Web Design will have their setup fully managed, including configuration, SSL, and launch.

  • If using a third-party host, the client is responsible for providing login credentials. Tosca Web Design will upload the site, test it, and ensure it functions as intended.

  • Hosting support is only provided for hosting accounts purchased through Tosca Web Design and linked to an active maintenance plan.

6. Maintenance Plans

  • Website maintenance plans are billed annually and auto-renew until the client cancels.

  • Clients may cancel at any time before the renewal date to avoid the next billing cycle.

  • Each plan includes specific services (text edits, media uploads, etc.) as detailed in your package.
    Additional services beyond your plan’s allowance will be billed at the à la carte rate.

7. Email Marketing Services

  • Clients are expected to provide email content (text and images).
    Light copyediting is included, but full copywriting is not part of the service.

  • If a client misses the delivery deadline for an eblast, it may result in rescheduling or delayed distribution.

8. Termination of Projects

  • Either party may terminate a project in writing.
    Refunds or service credits will be assessed according to the refund policy listed above and based on work completed to date.

  • No refunds are issued after final approval of the project.

9. Limitation of Liability

Tosca Web Design is not liable for any loss of income, business, or reputation resulting from downtime, plugin conflicts, third-party hosting issues, or client-side content errors. While every effort is made to ensure security and functionality, the client assumes final responsibility for ongoing website performance unless enrolled in an active maintenance plan.

10. Revisions to These Terms

Tosca Web Design reserves the right to update these Terms and Conditions at any time. Clients will be notified of major changes via email or website announcement.
